Introduction:

In a significant ruling, the Punjab & Haryana High Court has upheld the conviction in a murder case, emphasizing the realistic expectation from witnesses in presenting their testimonies. The case, titled Om Parkash v. State of Haryana, involved an appeal against the conviction for murder under Section 302 of the IPC and under Section 25 of the Arms Act. The court, comprising Justice Gurvinder Singh Gill and Justice N.S. Shekhawat, dismissed the appellant’s plea after considering the arguments and evidence presented before it.

Arguments of Both Sides:

The appellant, represented by Mr. Vaibhav Sharma, argued against the conviction, highlighting various inconsistencies in the testimonies of witnesses and contending that another individual, Prem Singh, was responsible for the murder, as per a separate complaint lodged by the deceased person’s brother. On the other hand, Ms. Sheenu Sura, Deputy Advocate General, Haryana, representing the State, defended the conviction, asserting the credibility of the prosecution’s case and the reliability of the witnesses’ testimonies.

Court’s Judgment:

The High Court, in its judgment, rejected the appellant’s arguments regarding the inconsistencies in witness testimonies and the involvement of another individual in the crime. The court emphasized that witnesses cannot be expected to provide a flawless account, especially after a significant period has elapsed since the incident. It deemed the second complaint filed by the deceased person’s brother as an afterthought and affirmed the credibility of the witnesses’ statements recorded immediately after the occurrence. Furthermore, the court noted the forensic evidence and post-mortem report supporting the prosecution’s case. In light of these observations, the court upheld the conviction in the murder case.
