Introduction:
In a recent case before the Allahabad High Court, a legal battle unfolded between the District Administration, Agra, and the Radhasoami Satsang Sabha. The Sabha, represented by its office bearers, challenged FIRs lodged against them by the District Administration, alleging illegal occupation of land. The saga began amidst a dispute over the rightful ownership of the contested property, with the Sabha vehemently asserting its rights.
Arguments:
The petitioners, represented by Counsel Manish Tiwary and Ujjawal Satsangi, argued that the FIRs were unjustly filed by the authorities without considering the pending writ petitions regarding the property’s title. They contended that the District Administration’s actions were retaliatory, aimed at pressuring the Sabha following the demolition drive on its land. Moreover, they refuted allegations of animal cruelty, asserting that no illegal activities were conducted on the Sabha’s premises.
On the other hand, the respondent authorities maintained that the FIRs were warranted, alleging criminal trespass and violation of animal cruelty laws. They argued that the demolition orders were justified due to the Sabha’s illegal occupation of the land, despite pending legal proceedings.
Court’s Judgement:
The bench, consisting of Justice Siddharth and Justice Syed Qamar Hasan Rizvi, drew upon previous rulings emphasizing the principles of natural justice. They found that the FIRs were lodged prematurely, before a determination of the civil dispute over land ownership. Consequently, the court quashed the FIRs against the office bearers of the Sabha, affirming the importance of due process and fair hearings.
