Rajasthan HC Clarifies Habeas Corpus Jurisdiction in Child Custody Disputes

Introduction:

In a recent ruling, the Rajasthan High Court clarified the circumstances under which habeas corpus petitions are maintainable in child custody disputes. The case involved a petitioner seeking custody of his son after the demise of his wife. However, the court emphasized that habeas corpus petitions are reserved for exceptional circumstances and are not suitable for custody disputes that have persisted for a long time.

Arguments of Both Sides:

Senior Advocate Rajesh Panwar, representing the petitioner-father, argued for the immediate adjudication of custody issues through a habeas corpus plea. On the other hand, the respondent state, represented by AAG M.A Siddiqui and Advocate Rohit Mutha, contended that the petitioner had alternative remedies available under the Hindu Minority & Guardianship Act, 1956, making the habeas corpus plea unnecessary.

Court’s Judgment:

The Division Bench, comprising Dr Justice Pushpendra Singh Bhati and Justice Rajendra Prakash Soni, dismissed the habeas corpus petition, stating that the circumstances did not warrant its intervention. The court emphasized that habeas corpus jurisdiction is reserved for extraordinary circumstances and cannot be invoked in custody disputes that have persisted for a long time. Additionally, the court highlighted the paramount importance of the welfare of the minor child, which should be assessed through a detailed inquiry before the competent court.
