No Right to Vote for Nominated Member in MCD Mayor Election : Supreme Court

The Supreme Court, presided over by DY Chandrachud, adjourned the hearing on the AAP and Shell Oberois’s petition until February 17th (Friday), in response to the Delhi lieutenant governor’s decision on whether to allow the nominated member to vote on the Municipal Corporation of Delhi (MCD) or not. 

DY Chandrachud’s bench also stated that “the law is very clear that a nominated member has no right to vote.”

Article 234U of the constitution mandates that elections to constitute a municipality should be completed well in time.

After the MCD elections, the first house convened on January 6 but adjourned due to BJP and AAP members exchanging some bitter dialogues; on January 24, the house was briefly adjourned; and the house adjourned for the third time due to clashes over a nominated member’s right to vote.

The total has 250 members: the AAP has 134 seats, the BJP has 104 seats, and the Congress won 9 seats. The AAP has clearly won the December polls.
