Will it shock you when your house gets demolished by the Bombay Municipal corporation without serving you proper legal notice? While hearing the petition filed by Ekta welfare society on the 8th Feb for the demolition of illegal encroachment by the railway authority, the Recent direction by the division bench of Justice Gautam Patel and Neela Gokhale of Bombay High court that outright bulldozing of illegal encroachment without giving aggrieved party chance to represent its case will not held to be right.

Supreme court in December 2021 gave direction in demolition matter that before pulling down the illegally raised structure the authority should serve notice to the person who has been identified as an encroacher. There should be proper rehabilitation for the aggrieved party and provide them help and relocate them under any reinstatement scheme run by the local authority.
