In the case of Ashwini Kumar Upadhyay v. UoI And Ors, the bench was held by supreme court Chief Justice DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala. Lawyer Ashwini Kumar Upadhyay filed 4 PIL and Lubna Qureshi filed one petition and Doris Martin filed one petition, the bench was hearing 6 petitions.
Senior Advocate Kapil Sibal objected to prayer and said this is a government work to decide but we cannot have such a petition with this kind of prayer.
Senior Advocate Gopal Sankaranarayanan said there are many petitions asking for the law commission to make a report, how asking for gender-neutral law is objecting to. One of the petitioners is a Muslim woman asking for gender-neutral law.
CJI DY Chandrachud said it is the work of legislation to make law.
Solicitor General of India Tushar Mehta said there is no objection to gender-neutral uniform law but it does not work on the judicial side.
Senior Advocate Kapil Sibal argued that not asking to issue a prima facie order but a signal to the legislature.
The bench said they would listen to a matter after four weeks.
