Madras High Court Dissolves Marriage Amidst Verbal Warfare

Introduction:

In a recent case, the Madras High Court, presided by Justice G Jayachandran and Justice C Kumarappan, observed that when a husband and wife engage in a relentless war of words, abuse, and vulgar criticism, the marital relationship becomes worthless and deadwood. The court was hearing a challenge against a Family Court order that had initially refused to dissolve the marriage between the parties.

Arguments:

The appellant husband and the respondent wife got married in 2017, and discord arose when the husband took a job abroad in 2018. Both parties lodged various allegations against each other, with the husband filing a petition citing regular harassment by his wife and false dowry harassment complaints. The wife claimed cruelty by the husband’s family and expressed a willingness to reconcile.

Court’s Judgment:

After scrutinizing the communication between the parties since 2019, the court opined that both were equally responsible for the separation and had caused mental cruelty. The abusive language used indicated no scope for reunion, and the court noted that the bloated egos of the parties had overshadowed any intention to save the matrimonial bond. The court dissolved the marriage, emphasizing that any remote possibility of reconciliation had weakened due to the wife’s suspicion of the husband remarrying.
