Madras High Court Denies Bail to Former Minister in Money Laundering Case

Introduction:

In a recent development, the Madras High Court, led by Justice Anand Venkatesh, has dismissed the bail plea of MLA and former Minister V Senthil Balaji. Balaji had been arrested by the Enforcement Directorate in June last year in connection with a cash-for-jobs money laundering case. While rejecting the bail plea, the court directed the Special Court to complete the trial within three months, considering Balaji’s more than eight months of incarceration.

Arguments:

Senior Advocate Aryama Sundaram, representing Balaji, argued that the accused had cast doubt on the prosecution’s materials, a sufficient ground for bail under Section 45 of the Prevention of Money Laundering Act. Balaji also alleged tampering of evidence by the investigating agency. The Enforcement Directorate (ED) countered, asserting that the court couldn’t conduct a mini trial during bail consideration. The ED emphasized Balaji’s potential influence as an MLA and the impact on candidates’ rights under Article 14 of the Constitution.

Court’s Judgment:

Justice Venkatesh dismissed Balaji’s claim of evidence tampering, noting that the agency relied on documents from the predicate offense, and the final report was based on unchallenged materials. The court acknowledged Balaji’s resignation from the Ministerial post but raised concerns about his eight-month continuation without portfolio, suggesting political influence. It deemed Balaji still influential, highlighting the risk of witness influence, especially given his prior attempt to compromise the predicate offense.
