Introduction:
Recent legal proceedings in the Sri Krishna Janmasthan-Shahi Idgah dispute have witnessed an application moved before the Allahabad High Court, urging the implementation of a Mathura court’s December 2022 order. This order directed a Civil Court Amin to conduct a spot inspection of the disputed site and submit a report. The application is filed by Bhagwan Bal Srikrishna Virajman Thakur Keshav Dev Ji through his representative and Vishnu Gupta, National President of Hindu Sena. The dispute involves a suit seeking possession of the Shahi Idgah premises and the demolition of the existing structure.
Arguments of Both Sides:
The applicants contend that the Mathura court issued orders for a spot inspection on December 8, 2022, and March 29, 2023, which were not complied with. The application seeks the High Court’s intervention for the implementation of the spot inspection order through a Court Amin. Meanwhile, the Supreme Court has adjourned pleas related to the Krishna Janmabhoomi-Shahi Eidgah Mosque dispute until April. The interim stay on a high court order appointing a commission to inspect the mosque premises in Mathura has been extended.
Court’s Judgement:
As of now, the Allahabad High Court is yet to deliver a judgment on the application seeking implementation of the Mathura court’s order. The Supreme Court, in its recent hearing, has deferred the main pleas related to the dispute until April. The legal proceedings are part of the larger controversy involving the Shahi Eidgah mosque’s alleged construction after demolishing a temple at the birthplace of Lord Krishna during Aurangazeb’s era.
