Karnataka High Court Grants Renowned Shooter’s Plea for Additional Arms and Ammunition

Karnataka High Court Grants Renowned Shooter’s Plea for Additional Arms and Ammunition

Introduction:

The Karnataka High Court has ruled in favor of renowned shooter K. Sajan Aiyappa, directing the Deputy Commissioner of Kodagu district to consider his application for four more arms and 25,000 ammunition. The court quashed the final notice issued to Aiyappa, emphasizing his status as a Renowned Shooter and his eligibility under Arms Rules, 2016.

Arguments of Both Sides:

Aiyappa, a prominent shooter with national and state-level achievements, claimed entitlement to ten arms as a Renowned Shooter under Arms Rules. The Deputy Commissioner’s final notice, seeking minimum qualifying marks, was challenged by Aiyappa, asserting that the communication was vague and lacked relevant information. The government contended that Aiyappa could possess only two arms under the Arms Act’s schedule.

Court’s Judgement:

The court rejected the government’s argument, categorizing Aiyappa as a Renowned Shooter eligible for ten arms under Clause 2(a) of the Arms Act’s schedule. It emphasized Aiyappa’s participation in shooting events and his claim to be a Renowned Shooter. The court upheld Aiyappa’s right to possess four additional arms and 25,000 ammunition, stating that all his claims aligned with statutory provisions.
