Kerala High Court Considers Legality of ED’s Money Laundering Investigation Against Public Company

Introduction:

In a recent hearing before the Kerala High Court, the Enforcement Directorate (ED) presented serious allegations against officials of Cochin Minerals and Rutile Ltd (CMRL). The ED asserted that the officials had committed cognizable offenses under the Prevention of Money Laundering Act, 2002 (PMLA), and misled the public by misappropriating substantial sums of money. The case, WPC 15757/2024, involves petitions to quash proceedings initiated by the ED based on an Enforcement Case Information Report (ECIR).

Arguments of the Parties:

The ED, represented by Special Counsel Zoheb Hussain, argued that CMRL officials had allegedly siphoned public funds through bogus expenses exceeding ₹133.8 crores. They claimed to have uncovered evidence suggesting illegal payments to politicians and public servants, including purported payments to Exalogic Solutions, owned by Chief Minister Pinarayi Vijayan’s daughter, Veena Vijayan, for services not rendered. The ED contended that these actions constituted cheating the general public and justified ongoing investigations. On the other hand, the petitioners—CMRL officials including Senior Manager N C Chandrashekharan and Chief Financial Officer K S Suresh Kumar—sought to quash the proceedings and challenged the validity of the ECIR. They argued that the inquiry was premature and emphasized their compliance with tax regulations, seeking immunity under the Income Tax Act.

Court’s Judgment:

Justice T R Ravi, presiding over the case, refused to quash the proceedings at this stage, highlighting that the inquiry by the ED was ongoing and necessary. The court acknowledged the seriousness of the allegations and directed the ED to preserve CCTV footage of interrogations. The matter was adjourned to July 01, 2024, for further deliberation.
