Defamation Case: Activist Medha Patkar Sentenced to Imprisonment and Compensation

Introduction:

In a significant legal development, a Delhi court has sentenced an activist leader to five months of simple imprisonment in a criminal defamation case. The case, initiated in 2001 by Vinai Kumar Saxena, currently Delhi’s Lieutenant Governor, accused the activist of defaming him through public statements. The court’s verdict, handed down recently, also includes a substantial compensation order.

Arguments of Both Sides:

Vinai Kumar Saxena, then Chief of an Ahmedabad-based NGO, alleged that Medha Patkar, a prominent leader of the Narmada Bachao Andolan, defamed him in a press release dated November 25, 2000. Patkar’s statements accused Saxena of involvement in hawala transactions and questioned his patriotism, claiming financial discrepancies in donations.

In her defense, Patkar maintained that her statements were made in public interest and based on facts. She argued that Saxena’s actions deserved scrutiny and criticism due to their purported implications for civil liberties and ethical conduct within NGOs.

Court’s Judgment:

The court found Medha Patkar guilty of criminal defamation under Section 500 of the Indian Penal Code. Judge Raghav Sharma of Saket Courts emphasized the deliberate and malicious nature of Patkar’s statements, ruling that they were crafted to tarnish Saxena’s reputation. The judgment noted that Patkar failed to substantiate her claims or demonstrate that her remarks were made in good faith. Consequently, Patkar was sentenced to five months of simple imprisonment, although the execution of the sentence was suspended for 30 days considering her age and health. Additionally, she was ordered to pay Rs. 10 lakh as compensation to Saxena for the damage caused to his reputation.
