Karnataka High Court Upholds Quality Control Notification on Polyethylene in Manufacturing

Introduction:

A recent judgment by the Karnataka High Court addressed a plea filed by the All India HDPE/PP Woven Fabric Manufacturers Association against a Government of India notification dated 15-04-2021. The plea challenged the imposition of quality control standards on polyethylene, a key component in plastic manufacturing, which was argued to adversely impact the market and favor certain industry players.

Arguments of Both Sides:

The association argued that the notification, aiming to impose quality control on raw materials like high-density polyethylene, was primarily beneficial to Reliance Industries. They claimed it would lead to monopolization by a dominant player, influencing the entire plastic manufacturing market. They urged for quality control to be imposed on finished products rather than raw materials.

Respondents countered, asserting the policy was a step towards maintaining quality standards and preventing the import of substandard raw materials, which might pose environmental and health hazards. They argued against judicial interference in government policy decisions related to quality regulations.

Court’s Judgement:

The Karnataka High Court dismissed the plea, upholding the government’s notification on quality control for polyethylene raw materials. The bench emphasized that ensuring quality at the raw material stage is crucial for producing standardized final products. It emphasized that adherence to Bureau of Indian Standards (BIS) quality standards at the raw material level was vital to prevent environmental hazards and ensure health and safety standards.

The Court declined to interfere in government policy, asserting that the imposition of quality control at the raw material stage aligns with the ‘Make in India’ initiative, enhancing the country’s competitiveness. It stressed that any intervention would only occur in cases demonstrating palpable arbitrariness, which was not evident in this instance.

The judgment highlighted the importance of quality control throughout the manufacturing process, ensuring the production of safe and standardized plastic products, thereby safeguarding the environment and public health.
