Karnataka High Court Orders Criminal Contempt Action Against Advocate for Misbehavior in Court

Introduction:

The Karnataka High Court has directed the initiation of criminal contempt proceedings against an advocate, M. Veerabhadraiah, for his alleged misbehavior during court proceedings. The court noted instances of misbehavior, arrogance, backtalk, and violation of court rules, leading to the decision to take action against the advocate. The directive came in a case titled ANNADURAI. K AND THE GOVT OF INDIA & Others, where Veerabhadraiah represented the petitioner.

Arguments of Both Sides:

The court observed that Veerabhadraiah’s behavior crossed the line when he threw his case files in dismay, addressed the bench in a loud voice, and refused to argue on merits despite repeated requests from the court. These actions were considered disrespectful and hindering the due course of judicial proceedings. Veerabhadraiah’s alleged misbehavior occurred after the court imposed costs on an application filed by him objecting to the caveator.

Court’s Judgement:

Justice K S Hemalekha, in a single-judge bench, directed the Registrar (Judicial) to initiate criminal contempt proceedings against Veerabhadraiah under the Contempt of Courts Act, 1971. The court emphasized that Veerabhadraiah’s actions undermined the dignity of the court and interfered with normal court proceedings. The directive reflects the court’s commitment to upholding decorum and ensuring the smooth administration of justice. Additionally, the court instructed the registry to notify the State Bar Council of the proceedings.
