Jharkhand High Court Rejects Bail for MLA Representative in Illegal Mining Case

Introduction:

The Jharkhand High Court has denied bail to Pankaj Mishra, an MLA representative of the former Chief Minister Hemant Soren, in connection with an illegal mining operation worth Rs 1000 crore. The court, while rejecting the bail petition, cited Mishra’s alleged pivotal role in the large-scale illegal mining activity, emphasizing the prima facie evidence suggesting his involvement in money laundering. This decision comes after the Enforcement Directorate (ED) apprehended Mishra in July 2022 for his suspected role in the illicit mining operation.

Arguments of Both Sides:

The court observed that Mishra’s status as a political representative and his close association with the then Chief Minister created political and administrative connections. The case involved allegations of substantial illegal mining activities, with Mishra being considered the kingpin. The court noted that the trial was at an early stage, with only ten witnesses out of 42 examined. Despite Mishra’s health condition being monitored by jail doctors, the court found no change of circumstance justifying his release on regular bail.

Court’s Judgement:

Justice Gautam Kumar Choudhary, in his observation, stated that there was prima facie evidence of Mishra’s pivotal role in money laundering associated with the illegal mining activity. The court emphasized the need for the trial court to expedite the proceedings. It rejected the bail application, affirming that Mishra’s actions suggested a potential undermining of the court’s dignity and interference with normal judicial proceedings.
