Jammu and Kashmir High Court Closes PIL Alleging Environmental Pollution from Kishan Ganga Hydroelectric Project

Introduction:

The Jammu and Kashmir High Court recently addressed a Public Interest Litigation (PIL) filed by Nazir Ahmad Pandit and others concerning alleged environmental pollution caused by the Kishan Ganga Hydroelectric Project (KGHP). Chief Justice N. Kotiswar Singh and Justice Moksha Khajuria Kazmi presided over the case, which raised significant concerns about the project’s impact on the surrounding ecosystem.

Arguments:

The petitioners raised various issues, including pollution of the Bonar Nallah, compensation for affected residents, employment opportunities, and adherence to environmental norms. In response, the Union of India and NHPC officials defended the project’s execution, citing strict adherence to environmental safeguards and compensation measures already implemented.

Court’s Judgement:

After evaluating the submissions and the NHPC’s affidavit confirming compliance with environmental safeguards, the Court closed the PIL. However, it emphasized the role of the Jammu and Kashmir Pollution Control Board in monitoring environmental damage and mandated appropriate action if any violations are discovered.
