Gujarat High Court Upholds Charges Against Pharmaceutical Firm Owner for Violating Prohibition Laws

Gujarat High Court Upholds Charges Against Pharmaceutical Firm Owner for Violating Prohibition Laws

Introduction:

In a recent ruling by the Gujarat High Court, the case of Amod Anil Bhave versus the State of Gujarat has brought to light the intricate interplay between the Drugs and Cosmetics Act and the Gujarat Prohibition Act, 1949. The petitioner, owner of a pharmaceutical firm, faced charges of selling intoxicating substances disguised as ayurvedic medicine, in violation of the state’s prohibition laws.

Arguments:

The petitioner’s defense rested on the contention that proceedings under the Drugs and Cosmetics Act should exempt them from prosecution under the Gujarat Prohibition Act. However, the prosecution argued that the presence of alcohol levels exceeding the permissible limit under the Prohibition Act warranted separate charges.

Court’s Judgement:

Justice Hasmukh D. Suthar, presiding over the bench, affirmed the charges against the petitioner, emphasizing that the objectives of the two acts differed significantly. While the Drugs and Cosmetics Act primarily regulates the manufacture and distribution of drugs, the Gujarat Prohibition Act aims to eradicate the consumption of intoxicants. The court underscored the duty of the state to uphold public health and enforce prohibition laws, in line with constitutional directives.
