Delhi High Court Grants Parole for Convicted Murderer’s Engagement and Marriage

Introduction:

In the case of Rahul Dev v. State, the Delhi High Court granted two weeks parole to Rahul Dev, a man convicted in a murder case and sentenced to life imprisonment, to attend his engagement ceremony and marriage. Rahul Dev was convicted in 2014 under Sections 302 and 201 of the Indian Penal Code and sentenced to life imprisonment. His engagement was scheduled for April 24, followed by his marriage on April 30 in an Arya Samar mandir in the national capital.

Arguments:

Rahul Dev’s counsel, Ms. Priyal Bhardwaj and Mr. Chetan Bhardwaj, advocated for his parole, citing the significant life events of his engagement and marriage. They emphasized his good conduct during his incarceration, as evidenced by the remission received.

On the other hand, the respondent’s counsel, Sanjay Lao with Ms. Priyam Aggarwal, representing the state, may have argued against the grant of parole, considering the seriousness of Dev’s crime and the need for judicial discretion in such matters.

Court’s Judgment:

Justice Amit Sharma, after considering the facts and circumstances, allowed Rahul Dev’s petition and granted him parole for two weeks. The court directed the parole to be counted from the date of Dev’s release and instructed him to surrender immediately to the jail superintendent upon its expiry.
