Introduction:
In a significant development ahead of the general elections, the Andhra Pradesh High Court addressed a Public Interest Litigation (PIL) challenging an order of the Election Commission of India (ECI) regarding the distribution of cash benefits under social welfare schemes. The case, marked as PIL 83 of 2023, saw spirited arguments from both sides regarding the role of volunteers in disbursing essential benefits to vulnerable sections of society.
Arguments of Both Sides:
The petitioner, represented by Counsel Gundala Siva Prasad, raised concerns about the immediate impact of the ECI’s order on beneficiaries who relied on door-to-door delivery of pension payments. Particularly, individuals with disabilities or restricted mobility faced challenges in accessing village secretariats to collect their pensions. On the other hand, Counsel for the respondents, including G.P. for Panchayat Raj & Rural Development, Harish Rasineni, and D.S. Sivadarshan, defended the ECI’s order as a necessary step to eliminate any potential for undue influence or bias in the electoral process. They emphasized the importance of upholding the integrity of elections and ensuring public confidence therein.
Court’s Judgement:
The Division Bench of Chief Justice Dhiraj Singh Thakur and Justice R Raghunandan Rao disposed of the PIL after considering the arguments presented by both sides. The Court noted the State’s efforts to ensure uninterrupted disbursal of pensions and other benefits to beneficiaries, particularly those belonging to vulnerable categories. It upheld the circular issued by the government, which mandated door-to-door distribution of pensions to individuals with disabilities, serious ailments, bedridden conditions, and elderly widows of war veterans drawing sainik welfare pensions. The Court’s decision addressed the petitioner’s concerns regarding potential hardships faced by vulnerable groups, thereby striking a balance between electoral reforms and social welfare.
