Kerala High Court Reiterates Accountability of Police, Stresses Civilized Conduct

Kerala High Court Reiterates Accountability of Police, Stresses Civilized Conduct

Introduction:

The Kerala High Court has emphatically reaffirmed the accountability of police officers to the public and condemned inappropriate behavior. The court, addressing a contempt petition related to an incident at Alathur Police Station, highlighted the importance of civilized police conduct and emphasized that circulars issued in the past should be taken seriously. State Police Chief Shaik Darvesh Saheb informed the court about a recent circular (Circular. 2/2024/PHQ dated 30.01.2024) aimed at ensuring proper behavior from police officers towards citizens.

Arguments of Both Sides:

The contempt petition alleged a violation of court directives to refrain from disrespectful language. The State Police Chief assured the court of the intent to modernize the police force, emphasizing the significance of the newly issued circular. The court observed that despite numerous circulars issued since 1965, untoward incidents persisted, suggesting a lack of serious consideration by police officers.

Court’s Judgement:

Justice Devan Ramachandran stressed that police officers are accountable to the public, and any misconduct will not be tolerated. Acknowledging the State Police Chief’s commitment, the court expressed optimism that proper implementation of the circular would bring about a positive change. The court recognized that isolated incidents could tarnish the collective dignity of the entire police force and citizens.
