Upholding Medical Board’s Authority: A Case Study in Constable Recruitment Dispute

Introduction:

In the case of Shri. Munna Singh versus Union of India and Ors, the Meghalaya High Court addressed a plea regarding the appointment of Mr. Singh as a Constable (GD) in CAPF’s and Rifleman in Assam Rifles. The dispute centered around Mr. Singh’s hearing impairment, as assessed by the Medical Board, despite conflicting opinions from other doctors.

Arguments of Both Sides:

Mr. Singh, the petitioner, contested the Medical Board’s assessment, arguing that it violated his rights under Articles 14, 16, and 21 of the Constitution of India. He claimed that the initial medical report contained errors and sought a review, which upheld the Board’s findings. Conversely, the Deputy Solicitor General representing the respondents emphasized adherence to recruitment guidelines and the conclusive nature of the Medical Board’s opinion. It was asserted that Mr. Singh’s hearing impairment rendered him unfit for the position, as per the required fitness standards.

Court’s Judgement:

Chief Justice S. Vaidyanathan underscored the authority of the Medical Board’s opinion, stating that it takes precedence over differing assessments. Despite recent interference with recruitment guidelines in another case, the Court declined to question the Medical Board’s expert opinion in this instance. Consequently, the writ petition was dismissed, affirming the Medical Board’s assessment of Mr. Singh’s fitness for the position.
