Supreme Court Upholds Freedom of Press in Defamation Case Ruling

Introduction:

In a significant verdict, the Supreme Court quashed a criminal defamation case against the owner of the ‘Sunday Blast’ newspaper in Madhya Pradesh. The case arose from a 2013 article titled “Advocate ne pan masala vyavasayi par karaya jhuta mamla darj” (advocate files false case against Pan Masala trader). Despite initial rejection by a Judicial Magistrate citing the fundamental right to freedom of speech and expression, the Sessions Court revived the case, a decision later upheld by the Madhya Pradesh High Court. The accused approached the Supreme Court, which, concurring with the Magistrate’s view, emphasized the publication’s good faith and exercise of freedom of speech.

Arguments of Both Sides:

The newspaper owner faced a criminal defamation case for the article published against an advocate. The Magistrate had initially rejected the complaint, emphasizing the fundamental right to freedom of speech and expression. However, the Sessions Court and the High Court revived the case, prompting the accused to appeal to the Supreme Court. The defense argued that the news article was published in good faith and within the bounds of the Constitution’s Article 19(1)(a). The prosecution contended that the Magistrate’s rejection was unjustified, leading to further legal proceedings.

Court’s Judgement:

The Supreme Court, comprising Justices BR Gavai and Sandeep Mehta, upheld the Magistrate’s decision, emphasizing the fundamental right to freedom of speech and expression. The Court deemed the news article to be published in good faith and within the constitutional framework. It ruled that the Magistrate’s view was neither illegal nor unjustified, and thus, interference by the Sessions Court or the High Court was unwarranted. Consequently, the Supreme Court quashed all proceedings related to the criminal defamation case under Section 500 of the Indian Penal Code.
