Supreme Court Seeks Status Report on ‘Kavach’ System Implementation in Indian Railways

Introduction:

In a significant development, the Supreme Court, on February 5, sought a detailed status report from the Union Government regarding the future planning of the implementation of the anti-collision ‘Kavach’ system in the Indian Railways. The matter, brought to the court’s attention through a Public Interest Litigation filed by Advocate Vishal Tiwari, addresses concerns about safety measures and the delayed implementation of the Kavach System. The court had previously requested the Attorney General for India to provide information on the government’s progress in this regard.

Arguments:

The counsel representing the Union Government highlighted the challenges in the rapid implementation of the ‘Kavach’ system, citing dependence on foreign working material and foreign competition posing obstacles. Despite the acknowledged seriousness of the government towards the project, the counsel emphasized the technical complexities involved in covering the entire nation.

Justice Kant inquired about the government’s future plan, recognizing the ambitious nature of the project. Justice Viswanathan sought information on any existing reports indicating partial implementation, especially in response to parliamentary queries. The counsel explained the vast technical dimensions involved in achieving nationwide coverage.

Court’s Judgement:

In response to the counsel’s request, the court granted four weeks to file a detailed status report. The matter is scheduled for the next listing after six weeks.
