Introduction:
The Supreme Court recently granted bail to Upendra Nath Dalai, who faced contempt proceedings for non-payment of imposed costs and making contemptuous remarks against the Court. The case arose from the dismissal of Dalai’s PIL seeking to declare Satsang founder Sree Sree Thakur Anukulchandra a “parmatma,” with the Court imposing a fine of Rs. 1 lakh. Dalai’s failure to pay led to the initiation of contempt proceedings.
Arguments:
The Court issued a non-bailable warrant against Dalai in January after he failed to appear, eventually leading to his arrest. Despite opportunities to file a procedural reply, Dalai submitted a reply containing additional contemptuous remarks. The seriousness of the matter prompted the Court to appoint Senior Advocate PN Mishra as Amicus Curiae. Additional criminal contempt charges were added for Dalai’s email replies scandalizing the Court’s authority.
Court’s Judgement:
While not satisfied with Dalai’s response to the Court’s notices, the bench granted bail in the interest of justice. The Chief Judicial Magistrate, Balasore, Odisha, will impose terms and conditions on Dalai’s bail. Pending the CJM’s decision, Dalai must attend Court on April 2, 2024. The Registry was directed not to accept new filings from Dalai until the current matter is decided.
