Supreme Court Defers YouTuber Ranveer Allahabadia’s Passport Release Amidst Ongoing FIR Investigation

Introduction:

The Supreme Court of India, in a significant hearing on April 1, 2025, deferred the plea of YouTuber Ranveer Allahabadia, popularly known as Beer Biceps, for the release of his passport. The case, W.P.(Crl.) No. 83/2025, titled ‘Ranveer Gautam Allahabadia v. Union of India and Ors.’, was heard alongside W.P.(Crl.) No. 85/2025, involving YouTuber Ashish Chanchlani, is also facing similar allegations. The controversy stems from the remarks made by both influencers during an episode of ‘India’s Got Talent,’ a YouTube show hosted by comedian Samay Raina. The content of the show, which included explicit discussions on sensitive topics, triggered massive public outrage, leading to multiple FIRs being lodged across different states. The Supreme Court had previously granted Allahabadia interim protection, with conditions including the deposition of his passport with the Thane Police. However, during the latest hearing, the bench of Justices Surya Kant and N. Kotiswar Singh decided to postpone the decision on his passport release, considering the ongoing nature of the investigations.

Arguments:

Allahabadia’s counsel, Dr. Abhinav Chandrachud, argued that his client’s livelihood depends on interviewing prominent personalities, both within and outside the country. He emphasized that international travel is an integral part of Allahabadia’s work as a content creator and that his professional engagements are time-sensitive, often requiring him to travel at short notice. Furthermore, Chandrachud highlighted Allahabadia’s compliance with all previous court directives, including statements given to the Mumbai and Guwahati police, as well as to the National Commission for Women. He also stressed that Allahabadia had filed an undertaking, ensuring that his future content would adhere to standards of decency and avoid sub-judice matters.

On the other hand, Solicitor General Tushar Mehta, representing the State, opposed the plea, stating that the investigation was nearing completion and could be concluded within two weeks. He argued that allowing Allahabadia to travel abroad at this juncture could potentially hinder the probe, as his presence might be required for further questioning. Justice Surya Kant, concurring with the SG’s stance, remarked that frequent travel could disrupt the investigation process and that the Court would reconsider the passport release only after the completion of the ongoing probe.

Court’s Judgment:

After hearing both sides, the Supreme Court deferred the decision on Allahabadia’s passport release, scheduling the next hearing for April 21, 2025. The Court emphasized that the ongoing investigations should be given priority and that Allahabadia might be required for questioning. The interim protections granted to him would continue until the next hearing. The Court also took note of the plea by both Allahabadia and Chanchlani to club the multiple FIRs filed against them in various states. While no immediate decision was made on this request, the bench assured that the matter would be examined in due course.

The controversy surrounding ‘India’s Got Talent’ has sparked a broader debate on the regulation of online content. The Supreme Court has indicated its intent to explore possible frameworks for overseeing explicit material on digital platforms. The Union Government has been asked to submit its views on potential regulatory measures to curb obscenity on social media. Meanwhile, comedian Samay Raina, one of the key figures in the controversy, has already issued a public apology and removed all episodes of the show from his YouTube channel. Allahabadia, too, has apologized publicly for his comments, acknowledging their inappropriate nature.
