Introduction:
In a recent ruling by Justice Anoop Chitkara of the Punjab & Haryana High Court, the court addressed the pressing issue of cybercrime facilitated by the unrestricted issuance of multiple prepaid SIM cards. The case, involving an individual accused of cybercrime, sparked scrutiny into the absence of governmental measures restricting individuals to a single prepaid SIM card and the rationale behind permitting entities such as firms and companies to acquire prepaid SIM cards.
Arguments of Both Sides:
The petitioner, represented by Mr. Vikas Arora, advocated for the issuance of only one prepaid SIM card per individual to mitigate cybercrime. On the other hand, Mr. Rajat Gautam, Addl. A.G. of Haryana, countered, highlighting the need for thorough verification procedures in issuing SIM cards to individuals and entities.
Court’s Judgment:
Justice Anoop Chitkara emphasized the need for governmental measures to limit individuals to a single prepaid SIM card, citing the significant role multiple SIM cards play in cybercriminal activities. The court suggested validating SIM cards linked to Aadhar cards and providing an option to convert validated SIM cards into postpaid ones. Additionally, the court impleaded the Union Government and the Ministry of Telecommunication to address the issue comprehensively.
