Section 64, CrPC deals with serving summons when the person concerned can’t be found. It states about leaving the summons with some male member of his family residing with him.
In Kush Kalra V. Union of India, Supreme Court has issued notice on a plea challenging Section 64, CrPC. The main contention, in this case, is that Section 64 is discriminatory as it speaks of summons only upon adult male members of the house.
