Patna High Court Upholds Pension Rights: Victory for Renowned Singer Sharda Sinha

Introduction:

The Patna High Court recently delivered a significant judgment, granting relief to the acclaimed 71-year-old folk and classical singer, Padmabhushan Sharda Sinha. The Court set aside a government order that led to the cessation of pension and other retirement benefits for Sinha, who served as a professor at Lalit Narayan Mithila University (LNMU), Darbhanga. The legal victory not only restores Sinha’s rightful entitlements but also establishes broader principles regarding the regularization of service and the protection of pension rights for long-serving employees.

Arguments of Both Sides:

The case revolves around the government’s order, prompted by the Education Department, Bihar, which resulted in the withholding of Sinha’s pay slip and the suspension of her pension payments. The petitioners, including Sinha and another LNMU professor, Dr. Uday Kant Mishra, sought the quashing of this order. They argued that their services had been regularized, leading to the creation of vested rights that couldn’t be unilaterally divested without due process. The State contended that the regularization was illegal, relying on a memo issued by the Director, Higher Education, Govt. of Bihar.

Court’s Judgment:

Justice Harish Kumar, while allowing the writ petitions, underscored the importance of due process and natural justice. The Court observed that once an employee has been accorded all the benefits of a regular employee, including salary, increments, promotions, and unconditional superannuation, any attempt to terminate their services or cancel regularization should adhere to statutory rules and regulations. The Court relied on precedent, including the case of Secretary, State of Karnataka and Others v. Uma Devi (2006), emphasizing that regularization claims should be considered within six months from the judgment.
