Factual Background
A PIL was submitted by The petitioner, who identified himself as a public-spirited citizen and a social worker concerned with maintaining order in society, filed the current PIL in an effort to get the Government of Bihar to issue a proper writ ordering it to blacklist the company, S.P. Singla Construction (P) Ltd., which was given the job of building the 23.16-kilometer-long, four-lane Sultanganj Aguani Ghat Bridge, out of which 3.16-kilometer-long bridge was being built
Observation of the Court
Justice Purnendu Singh of the Patna High Court’s single-judge bench stated that the court was concerned to protect the interests of the general public and to stop the misappropriation of public funds and the exploitation of natural resources in the interest of society and the common people, both of which had been brought on by the State Government and the Contractor’s lax enforcement of their authority. As a result, the Court instructed the State Government to submit its action-taken report on the following day of the hearing and instructed S.P. Singla Construction (P) Ltd. to submit its research report relating to construction work carried out at the bridge building site.
The State Government, according to the Court, had taken the issue of the bridge collapsing seriously and had also taken action against the Company and its officials. The State Government was therefore ordered by the Court to submit its action taken report on the following hearing date. The court further ordered the managing director of S.P. Singla Construction (P) Ltd. to personally appear in court on the following hearing date with his expert team. The matter would be listed again on June 21, 2023.
