No Conviction Under Section 364A IPC Without Proof of Ransom Demand and Life Threat: Chhattisgarh High Court

No Conviction Under Section 364A IPC Without Proof of Ransom Demand and Life Threat: Chhattisgarh High Court

Introduction:

In the case before the Chhattisgarh High Court, appellants Yogesh Sahu and Nandu were acquitted of charges under Sections 364A, 343, and 323/34 of the Indian Penal Code (IPC). The trial court had convicted them for allegedly abducting Bhagwanta, demanding ransom, and wrongfully confining him. The appellants challenged this conviction, arguing that there was no evidence of a ransom demand and that Bhagwanta’s detention was aimed at recovering money owed from another party.

Arguments of Both Sides:

The prosecution contended that Yogesh Sahu and Nandu abducted Bhagwanta, demanding ransom for his release. They presented evidence suggesting Bhagwanta was detained against his will, with instructions to his wife to procure money from a third party. Conversely, the defense argued that Bhagwanta’s detention was not for ransom but to recover unpaid dues from Ghazi Khan, who had purchased Yogesh Sahu’s truck. They asserted that Bhagwanta’s testimony was fabricated due to their friendship and business dealings.

Court’s Judgment:

Upon careful examination of the evidence, the High Court observed that there was no conclusive proof of a ransom demand by the appellants. It noted that Bhagwanta’s detention appeared to be motivated by financial recovery rather than extortion. The court found discrepancies in the prosecution’s narrative and concluded that the charges under Section 364A (abduction with ransom demand) were not substantiated beyond reasonable doubt. Additionally, it ruled that the charges under Sections 343 (wrongful confinement) and 323 (voluntarily causing hurt) were unsupported by sufficient evidence. Therefore, the appellants’ conviction was overturned, and they were acquitted of all charges.
