Mumbai Court Allows Withdrawal of Prosecution in Television Rating Points (TRP) Scam

Mumbai Court Allows Withdrawal of Prosecution in Television Rating Points (TRP) Scam

Introduction:

The Chief Metropolitan Magistrate Court in Mumbai has granted the application filed by the Special Public Prosecutor representing the Maharashtra Police to withdraw all prosecutions related to the Television Rating Points (TRP) Scam, including charges against Arnab Goswami, the editor-in-chief of Republic TV. This move, under Section 321 of the CrPC, enables the Public Prosecutor to cease prosecution with the court’s consent, citing differing outcomes from investigations by three agencies.

Arguments:

Special Public Prosecutor Shishir Hiray justified the withdrawal by highlighting the legal and proper decision of the Maharashtra Government, supported by the Mumbai Police, due to varying results from the investigations by Maharashtra Police, CBI, and ED. Witnesses initially interviewed by Mumbai Police allegedly contested the accuracy of their statements under oath, raising concerns about the integrity of the case.

Court’s Judgement:

The Chief Metropolitan Magistrate approved the withdrawal of prosecutions, acknowledging the divergent findings from the investigations and the alleged discrepancies in witness statements. The decision emphasized the need for procedural correctness and recognized the legal authority’s prerogative to cease prosecution when deemed appropriate.
