Introduction:
Amidst the Maharashtra political fracas, the Legislative Assembly Speaker, Rahul Narwekar, declared Eknath Shinde’s faction as the authentic Shiv Sena during the rift within the party. The Speaker’s decision comes after a series of petitions seeking disqualification of members from both the Shinde and Uddhav Thackeray factions. The ruling carries significant implications for the state’s political landscape.
Main Reasons for Speaker’s Decision:
The Speaker emphasized that when the factions emerged, Eknath Shinde’s group held an overwhelming majority of 37 out of 55 MLAs. He deemed Shinde’s appointment as leader of the party as valid, asserting that Uddhav Thackeray lacked the authority to remove Shinde. The Speaker relied on the 1999 party constitution, which diluted power from the party chief, while the 2018 version, concentrating power, wasn’t on record. The decision also highlighted that Shinde’s faction couldn’t be disqualified for violating the whip as Sunil Prabhu ceased to be the authorized whip on June 21. The Speaker rejected using the Tenth Schedule as a tool to stifle intra-party dissent.
Speaker’s Decision:
Rahul Narwekar declined to disqualify members from both factions, stating that the Shinde faction’s non-attendance at the meeting could be considered an act of dissent, protected by freedom of speech and expression. Bharat Goghavle was validated as the whip, but the Speaker refused to disqualify Uddhav-led members for violating Goghavle’s whip due to insufficient proof of service.
