Maharashtra Civil Court denies plea to block Pathaan trailer and Besharam Rang song on YouTube

Advertising a new movie has many ways, one of the effective ways is controversy. Recently launched Bollywood movie Pathaan is also getting famous due to its controversy. 

In the case of Suresh Patil vs Yashraj film Lmt, a civil court in Maharashtra rejected the plea to restrain the broadcast of the trailer, advertisement, and teaser along with their songs, Besharam Rang song on youtube without a U/A censor certificate.

The civil court bench observed that no prima facie case was made out by the plaintiff to grant a temporary injunction stating that no loss would be caused if the plaintiff was not granted any temporary relief.

For temporary relief, a prima facie case would be present before the bench which clearly shows that if temporary relief is not granted the loss would occur.

The plea was moved by the social worker (Suresh Patil) claiming that the U/A censor board certificate was not showing on Youtube. Moreover, he further added that Rule 38 of the Cinematography Act, of 1953 makes it mandatory to show a certificate.

While defending that the film’s production house counter that there is no need for a certificate in online platforms like OTT and Youtube. 

Under the Cinematography Act 1953, the certificate required the theatrical description of films on the DVD. Platforms like Youtube are regulated under IT rules of 2021.

After consulting both sides, the court bench rejected the plaintiff’s application.
