Madhya Pradesh High Court Permits Termination of 17-Year-Old’s Disable Rape Survivor’s Pregnancy

Madhya Pradesh High Court Permits Termination of 17-Year-Old’s Disable Rape Survivor’s Pregnancy

Introduction:

In a significant decision, the Madhya Pradesh High Court has allowed the termination of a 17-year-old rape survivor’s pregnancy at 29 weeks, citing exceptional circumstances. The Division Bench, comprising Former Chief Justice Ravi Malimath and Justice Vishal Mishra, imposed certain conditions for the termination, emphasizing the survivor’s physical disability and the potential challenges she would face in managing the pregnancy. The case, marked by legal and medical complexities, addressed the intersection of reproductive rights, statutory provisions, and humanitarian considerations.

Arguments of Both Sides:

Advocates Hritvik Dixit and Priyanka Tiwari, representing the survivor, argued for the termination of pregnancy, stressing the survivor’s vulnerability and the need to safeguard her health and well-being. On the other hand, Additional Advocate General Harpreet Singh Ruprah, representing the respondents, contested the termination, citing statutory limitations and medical opinions. The court was tasked with reconciling these divergent perspectives while ensuring adherence to legal frameworks and medical standards.

Court’s Judgement:

The Division Bench, after considering medical reports and legal precedents, ruled in favor of permitting the termination of the survivor’s pregnancy. Acknowledging the unique circumstances of the case, including the survivor’s physical disability and the advanced gestational age, the court directed that the procedure be conducted by a team of expert doctors. The court emphasized the importance of informing the survivor and her family about the risks involved and ensuring access to necessary medical facilities.
