Madhya Pradesh High Court Grants Custody of Newborn to Minor Rape Survivor Under Parental Guardianship

Introduction:

The Jabalpur Bench of the Madhya Pradesh High Court, in a compassionate ruling, granted custody of a newborn child to her minor mother, a rape survivor, under the guardianship of the mother’s parents. Justice Avanindra Kumar Singh, presiding over the matter, emphasized that the mother is the best caregiver for her baby and prioritized the natural bond between the two. The court also directed the State Government to bear all medical expenses and provide necessary support to the family. The case stemmed from a writ petition filed after the court permitted the termination of the minor’s advanced pregnancy, resulting in the live birth of the baby on January 1, 2025.

Arguments of Both Sides:

The petitioner, represented by counsel, sought the custody of the newborn for the minor mother and her parents. It was argued that the family was ready to provide a safe, nurturing environment for both the mother and child. The counsel emphasized the need for natural breastfeeding and familial care, asserting that the earlier court order preventing contact between the mother and baby impeded the child’s welfare. The petitioner’s family also undertook to ensure the safety, nourishment, and proper upbringing of the newborn and requested the court’s intervention to allow the baby’s custody.

On the other hand, the State, represented by the Government Advocate, raised no objections to the application. The State acknowledged the willingness and readiness of the petitioner’s family to care for the child and affirmed its compliance with the court’s directions. It also confirmed that the baby, presently under specialized care in an ICU, was in good health. The State assured the court that it would abide by any directives regarding medical and welfare support for the mother and child.

Court’s Judgment:

After considering the submissions, the court observed that the minor mother and her parents had demonstrated their commitment to the child’s welfare. Justice Singh remarked that the mother is naturally the best caregiver for her child and that granting custody to the minor mother under her parents’ guardianship was in the best interest of both the baby and the mother. The court highlighted that separating the mother and child could adversely impact their emotional and physical well-being.

The bench noted the State’s readiness to comply with the directives and its assurance to assist the family. Acknowledging the family’s intention to care for the newborn within their home environment, the court directed that custody of the baby be immediately handed over to the minor mother under her parents’ guardianship. It further instructed the State Government to offer a “helping hand” to the family whenever required, by relevant laws.

Additionally, the court mandated that all medical expenses for both the minor mother and the newborn be borne by the State Government. It reiterated the importance of ensuring the safety and well-being of the mother and child, directing the State to remain vigilant and supportive.

The court concluded by disposing of the interlocutory application and the writ petition, providing a humane resolution to a sensitive issue involving the rights and welfare of a rape survivor and her child.
