In a recent case before the Kerala High Court, the petitioner, NATAK, an organization of artists, challenged an order by a Sub Divisional Magistrate directing them to alter the name of their drama, ‘Governorum Thoppiyum’. The petitioner argued that the title was misconstrued as a reference to the Governor of Kerala, while it was actually an adaptation of Friedrich Schiller’s novel, ‘William Tell’. The court, led by Justice Devan Ramachandran, delved into the intricacies of artistic expression, constitutional freedoms, and the jurisdiction of administrative authorities.

Arguments:

Advocates representing NATAK contended that the drama’s title solely referred to the lead character and did not intend to criticize constitutional functionaries. They emphasized artistic freedom and asserted that the order to alter the title was arbitrary and against the law. Conversely, the Government Pleader argued that the Sub Divisional Magistrate’s order was aimed at preventing potential law and order issues during the Cochin Carnival, where the drama was scheduled to be performed.
