Kerala High Court Issues Comprehensive Directions on Handling Minor Victims and Rehabilitation in Sexual Abuse Cases

Kerala High Court Issues Comprehensive Directions on Handling Minor Victims and Rehabilitation in Sexual Abuse Cases

Introduction:

The Kerala High Court has issued significant directives pertaining to the treatment and rehabilitation of minor victims of sexual abuse, the provision of therapy for prisoners under the POCSO Act, and sex therapy for survivors of sexual assault. These directives were prompted by a bail plea involving a 19-year-old accused of sexually abusing his minor sister. The court, acknowledging the sensitivity of the matter, sought guidance from Advocate A. Parvathi Menon, the Project Co-ordinator of the Victim Rights Centre (VRC).

Arguments of Both Sides:

The petitioner, accused of sexual assault, claimed innocence, attributing the charges to false implications arising from alleged drug-induced violent behavior. The Public Prosecutor opposed bail, citing the investigation’s findings and the filing of a final report supporting the accusations. Advocate Menon’s report highlighted the victim’s need for emotional support, emphasizing the family’s fragmented state due to the complaint. The court considered the petitioner’s substance abuse history but granted bail based on the completed investigation and the absence of withdrawal symptoms.

Court’s Judgment:

The court issued directions encompassing sensitization in schools, psychotherapy for prisoners under the POCSO Act, and sex therapy for sexual assault survivors. It emphasized that victims should not be treated differently and that treatment schemes should be implemented collaboratively. The court, granting bail, noted the petitioner’s custody since May 2023 and the completion of the investigation. The decision balanced the accused’s rights with the need for rehabilitation and sensitivity in handling such cases.
