Karnataka High Court Stays Further Investigation in Criminal Case Against Member of Parliament

Introduction:

In the case involving SHOBHA KARANDLAJE and the State of Karnataka, the Karnataka High Court stayed further investigation in a criminal case registered against Member of Parliament Shobha Karandlaje. The case stemmed from a statement made by Karandlaje linking a suspect in the Rameshwaram cafe blast with Tamil Nadu during a protest in Bengaluru. The High Court, represented by a single judge bench of Justice Krishna S Dixit, issued notice to the respondents and stayed the investigation based on sections of the Representation of People Act.

Arguments of Both Sides:

Advocate Venkatesh Dalwai, representing Shobha Karandlaje, argued that the alleged offences did not prima facie constitute an election offence. He contended that certain sections invoked against Karandlaje should only be applied to actions promoting or opposing voting for a particular candidate. The government advocate, however, defended the case registered by the Flying Squad officer of the Election Commission, suggesting that other sections of the Indian Penal Code may also apply.

Court’s Judgement:

The Karnataka High Court, while upholding the right to freedom of speech, stayed further investigation in the criminal case against Shobha Karandlaje. Justice Dixit’s bench cautioned Karandlaje to be measured in her speech, emphasizing the importance of exercising constraint, particularly for political leaders. The court questioned the applicability of certain sections invoked in the case and expressed concerns about potential violations of free speech rights. Accordingly, it issued a stay on further proceedings to ensure the protection of Karandlaje’s rights.
