Karnataka High Court Directs ICAI to Grant Membership to Student Pursuing Multiple Courses  

Introduction:

In a recent verdict, the Karnataka High Court addressed the plea of Nikkitha K J, a 23-year-old, seeking membership from the Institute of Chartered Accountants of India (ICAI) to practice as a Chartered Accountant. Nikkitha, while pursuing the CA course, completed various additional courses and faced resistance from ICAI regarding membership. The court’s decision assessed the permissions sought by Nikkitha and their compliance with ICAI regulations, emphasizing the student’s diligence and the pursuit of multiple courses to enhance her acumen.

Arguments of Both Sides:  

Nikkitha’s petition contested the ICAI’s denial of membership based on the pursuit of additional courses without proper permission. She argued that she diligently sought and obtained permission at each stage for pursuing various courses alongside her CA curriculum. The respondents, representing ICAI, claimed that Nikkitha violated Articleship Regulations and required permission for additional courses. They asserted that any entitlement to membership would only arise in 2025, with a Rs. 10,000 fine, for pursuing courses without proper permission.

Court’s Judgement:  

The High Court found Nikkitha’s pursuit of multiple courses diligently authorized by ICAI at each stage. It criticized the institute for attempting to impede the student’s career over alleged permission issues, highlighting Nikkitha’s genuine efforts to secure necessary approvals. The court emphasized that a student might not comprehend legal implications but should be encouraged to develop acumen by pursuing additional courses with permission. It directed ICAI to reconsider the grievance, enroll Nikkitha as a member, and acknowledged the student’s efforts to broaden her knowledge base.
