Arguments from both Sides

The petitioner claimed that the minor was innocent and had been wrongfully accused in the current case. He continued by saying that the knowledgeable Juvenile Justice Board did not take into account the fact that no one had witnessed the crime, as an informant who had just heard about it had filed the FIR rather than an eyewitness. The Juvenile Justice (Care and Protection of Children) Act of 2015’s Section 12 directive was not taken into account by the knowledgeable Board.

The accused aggressively refuted the allegations and contends that it is clear from the DPO report that the Juvenile suffers from rage issues because he has admitted as much. For Section 12’s mandate to be applied to the revisionist’s case, he also said that the DPO report does not support and fairly cover the argument of the petitioner. He also argues that the accused is a juvenile and that there is no eye witness to the said incident current juvenile is innocent of committing a terrible crime and that as a result, he is entitled to any bit of relief.

Analysis of court order

A single high court panel from Allahabad According to Justice Shree Prakash Singh, the accused can receive the benefit of bail. The Juvenile Justice Board’s contested order makes it clear that the juvenile was 16 years, 8 months, and 7 days old at the time of the occurrence. Therefore, it has been determined that the juvenile, whose grandmother filed the FIR, is not an eyewitness. The other witnesses, in this case, are merely relying on hearsay and are not eyewitnesses either.
