Introduction:
In a recent development, a Vacation Bench of the Delhi High Court has taken cognizance of a plea filed by world boxing champion Nitu Ghanghas, who is seeking redressal for the omission of her name from the Arjuna Award for Outstanding Performance in Sports and Games (2023). The petitioner, Nitu Ghanghas, a gold medalist in the Commonwealth Games 2022 and the IBA Women’s World Boxing Championship/World Cup 2023, hails from Bhiwani district in Haryana. At the age of 23, she stands as the 6th Indian boxer, male or female, to clinch a world championship. Coach Jagdish Singh, the founder of Bhiwani Boxing Club and former mentor of Vijender Singh, first identified Nitu’s talent. In response to the petition, Senior Advocate Mohit Mathur, representing Nitu, argues that her exclusion from the Arjuna Awardee list is unjust, unreasonable, and a violation of Article 14 of the Constitution of India. On the other side, CGSC Anil Soni assures that the representation submitted would be duly considered.
Arguments:
Senior Advocate Mohit Mathur, appearing for Nitu, contends that her stellar achievements, including winning gold in the Commonwealth Games and the IBA Women’s World Boxing Championship/World Cup, make her a deserving candidate for the prestigious Arjuna Award. He emphasizes the unfairness and unreasonableness of her exclusion, asserting that such oversight contradicts the principles of equality enshrined in Article 14 of the Constitution of India. Mathur points out that Nitu’s representation regarding the omission has already been submitted, seeking prompt consideration.
In response, CGSC Anil Soni acknowledges the submission of the representation and assures the court that due consideration would be given to Nitu’s case. While not explicitly conceding to the merit of the claim, Soni signals a willingness to address the issue, indicating a potential resolution without protracted legal proceedings.
Court’s Judgement:
Justice Neena Bansal Krishna, presiding over the case, has called for a response from the concerned authorities. The matter has been listed for further hearing on January 1, 2024. The court’s decision to seek a response implies a measured approach, giving the Sports Authority of India and other respondents an opportunity to address Nitu’s claims before making a final determination. The court’s action suggests a commitment to fairness and due process in adjudicating matters related to sports awards and recognitions.
