The Himachal Pradesh High Court has taken decisive action in a case challenging the appointment of Parliamentary Secretaries in the state, closing arguments for private respondents due to repeated failures by their legal representatives to appear before the Court. The case questions the legality of the Himachal Pradesh Parliamentary Secretaries Act, 2006, raising concerns over the State Legislature’s authority to enact such legislation.
Arguments of Both Sides:
The case, under the scrutiny of the court since April 22, 2023, has seen consistent absences and delays from the counsels representing the private respondents, despite the court’s efforts to facilitate a fair hearing. The core issue revolves around the competence of the State Legislature to pass the legislation. However, the private respondents’ legal representatives have repeatedly avoided addressing arguments or sought unwarranted adjournments, prompting the court to take unprecedented action.
Court’s Judgement:
Expressing deep concern over the conduct of the private respondents’ counsels, the bench closed arguments for the private respondents, emphasizing an advocate’s duty to assist the court in imparting justice. The court granted one final opportunity to the State respondents to present their arguments, scheduling day-to-day proceedings starting from May 8, 2024. Additionally, the court indicated a reconsideration of a previous stay order depending on the conduct of the respondents and their legal representatives in the upcoming proceedings.
