Himachal Pradesh High Court Clarifies Pension Entitlements: Temporary Assignments Don’t Qualify for Higher Pension

Introduction:

In the case of Bishan Singh Chandel v. Sh. Balwan Chand and another (COPC No. 197 of 2022), the Himachal Pradesh High Court addressed the issue of pension calculation for employees temporarily assigned higher responsibilities before retirement. Justice Ajay Mohan Goel presided over the matter, focusing on whether such temporary assignments should influence pension benefits.

Arguments:

Petitioner’s Perspective:

Mr. Bishan Singh Chandel, represented by Senior Advocate Mr. Sanjeev Bhushan and Advocate Mr. Rajesh Kumar, contended that he served as a Planning & Development Officer from November 12, 2014, to March 31, 2015. He argued that his pension should be calculated based on this role, citing CCS (Pension) Rule 49(2), which allows pension computation based on the last drawn salary if more beneficial to the employee.

Respondents’ Perspective:

Represented by Additional Advocate General Mr. Rajpal Thakur, the respondents maintained that Mr. Chandel’s substantive post was not that of a Planning & Development Officer. They emphasized that temporary assignments without formal promotion should not influence pension calculations.

Court’s Judgment:

Justice Goel clarified that while Mr. Chandel was entitled to pay and allowances for his temporary role, this did not equate to a formal promotion. The court highlighted that accepting such claims could set a precedent where employees nearing retirement might seek temporary higher assignments to boost pension benefits, undermining the promotion system’s integrity. Consequently, the court dismissed the contempt petition, finding no willful disobedience by the university.
