High Court Takes Suo Motu Cognizance of Elderly Woman’s Semi-Naked Parade Incident

Introduction:

The Punjab & Haryana High Court has initiated suo moto cognizance of a distressing incident wherein an elderly woman was paraded semi-naked in Punjab’s Taran Taran district. The shocking incident, reminiscent of Draupadi’s disrobing during the Mahabharat era, prompted the court to intervene and seek accountability from the authorities. The court’s proactive stance reflects its commitment to upholding justice and protecting the dignity of individuals.

Arguments of Both Sides:

The court, led by Administrative Judge Justice Sanjay Vashisht, highlighted the gravity of the incident, drawing parallels to the historical injustice suffered by Draupadi. Justice Vashisht emphasized the judiciary’s obligation to prevent such heinous acts and ensure prompt action against the perpetrators. On the other hand, the Punjab Government, represented by Additional Advocate General Saurav Khurana, is expected to provide a comprehensive response and a status report on the actions taken against the accused.

Court’s Judgement:

The division bench, comprising Acting Chief Justice G.S. Sandhawalia and Justice Lapita Banerji, issued notice to the State and directed immediate steps to remove the video from social media platforms. Furthermore, the court sought a detailed status report on the actions taken against the accused individuals. Justice Vashisht’s remarks underscored the court’s proactive approach in safeguarding the dignity and rights of individuals, especially in cases of gender-based violence and societal injustices.
