The Jammu and Kashmir and Ladakh High Court has issued a significant order to transfer the trial in the murder case of Advocate Babar Qadri from Srinagar to the court of Special Judge Designated under the NIA Act in Jammu. Babar Qadri, a well-respected lawyer, was fatally attacked at his residence in Srinagar on September 24, 2020, by unknown terrorists. The High Court’s intervention addresses the challenges of conducting a fair trial in Srinagar, acknowledging threats faced by witnesses and the inability to secure legal representation.

Arguments:

The Managing Committee of the Delhi Waqf Board, representing the interests of Advocate Babar Qadri, sought the transfer of the murder trial to Jammu due to threats and hostility faced by witnesses. The family of the deceased and other vital witnesses reported constant threats, hindering a fair and impartial trial in Srinagar. The Senior Additional Advocate General, Mr. Mohsin Qadri, argued that protection of life and liberty for witnesses and a fair trial was impossible in the current circumstances.

On the other side, the defense questioned the locus standi of the Delhi Waqf Board’s Managing Committee in seeking the transfer. They contended that the demolition action was based on the religious committee’s recommendation, not discriminating between structures. Court’s Judgement:

Justice Rajnesh Oswal of the Jammu and Kashmir and Ladakh High Court allowed the transfer plea, considering the peculiar facts of the case. The court noted the threats faced by witnesses and the absence of legal representation in Srinagar, emphasizing the importance of a fair, transparent, and impartial trial. Justice Oswal ruled in favor of the transfer, directing the case to be heard in the court of Special Judge Designated under the NIA Act in Jammu.
