High Court Orders Compensation in Failed Sterilization Case: Balancing Negligence and Financial Hardship

High Court Orders Compensation in Failed Sterilization Case: Balancing Negligence and Financial Hardship

Introduction:

In a recent ruling by the Orissa High Court, a woman who conceived and delivered a baby girl despite undergoing sterilization surgery was granted compensation of rupees thirty thousand. The case sheds light on issues of medical negligence, mismanagement of public funds, and the implications of family planning programs on individuals, particularly those from economically disadvantaged backgrounds.

Arguments:

The petitioner argued that the failure of the sterilization surgery pointed to negligence on the part of the doctors and highlighted the shortcomings of the state’s family planning initiatives. Additionally, it was emphasized that suitable compensation was necessary not only for the negligence but also for the well-being of the newborn child. Conversely, the state contended that a fixed amount of compensation was already designated under the Family Planning Insurance Scheme and questioned the necessity of additional compensation, particularly due to the gender of the newborn child.

Court’s Judgement:

The Orissa High Court, while acknowledging the inherent risks associated with sterilization surgeries, cited Supreme Court precedent indicating that failure due to natural causes does not warrant compensation. However, considering the petitioner’s poor financial background, the court deemed it appropriate to grant compensation of rupees thirty thousand as a measure of relief.
