In a recent ruling by the High Court of Jammu and Kashmir and Ladakh, Justice Javed Iqbal Wani elucidated on the application of the principle of “equal pay for equal work.” The court addressed a plea concerning the disparity in pay between Data Operators in various government departments, emphasizing factors beyond job titles or designations.

Arguments:

The petitioners, Data Operators in the State Pollution Control Board, contended that they were entitled to higher pay akin to Data Operators in other departments. They invoked constitutional principles of equality, non-discrimination, and “equal pay for equal work.” The government countered, highlighting differences in job roles and asserting the petitioners’ voluntary acceptance of terms.

Court’s Judgement:

Justice Javed Iqbal Wani elucidated that parity in pay isn’t solely based on job titles but on factors like responsibilities, experience, and confidentiality. The burden of proving equality lies with the claimant. Despite invoking constitutional principles, the petitioners failed to demonstrate equivalence in job roles. Hence, their plea was dismissed as legally untenable.
