In a recent ruling by the Delhi High Court, the Unique Identification Authority of India (UIDAI) has been directed to furnish all relevant information pertaining to a forged Aadhar card recovered from an individual accused of supplying counterfeit currency notes. The case arose when Delhi Police sought verification of the forged Aadhar card with the UIDAI database after discrepancies were found during an investigation.
Arguments:
The Delhi Police, represented by Mr. Laksh Khanna, Assistant Public Prosecutor, argued that the information requested fell within the ambit of “identity information” under the Aadhar Act and was crucial for the proper investigation and adjudication of the case. They contended that disclosing such information did not infringe upon the privacy rights of the cardholder.
On the other hand, counsel for UIDAI, Mr. Sushil Raaja and Mr. Kapil Dev Yadav, along with counsel for the accused, Ms. Tanushree Chakraborty and Mr. Nazim, argued against disclosing the information, citing privacy concerns and the need for proper authorization under the Aadhar Act.
Court’s Judgement:
Justice Manoj Kumar Ohri, presiding over the case, directed UIDAI to provide all relevant information regarding the forged Aadhar card for verification purposes.
