Introduction:
In a significant legal development, the Gujarat High Court has denied bail to Kalpesh Turi, a former technical officer at the Indian Space Research Organisation (ISRO), who is facing charges of cyber terrorism. Turi allegedly sent photographs related to ISRO’s Space Applications Centre to a woman in Pakistan, sparking concerns about national security and unauthorized dissemination of sensitive information.
Petitioner’s Arguments:
Senior Advocate Shalin Mehta, representing Turi, argued that the photographs shared by his client were neither secret nor sensitive in nature. He contended that Turi was unaware of the recipient’s location and believed he was sharing innocuous workplace selfies. Mehta emphasized that the information shared did not pose a threat to national security or intellectual property.
Prosecution’s Arguments:
The prosecution countered Mehta’s claims, asserting that the photographs depicted sensitive areas of ISRO’s SAC premises in Ahmedabad. They argued that Turi’s actions constituted a breach of trust and raised serious concerns about the unauthorized dissemination of classified information. The prosecution highlighted the potential implications for national security and the integrity of ISRO’s operations.
Court’s Judgement:
Justice MR Mengdey, presiding over the case, denied bail to Turi for the second time, citing the commencement of the trial and the examination of several prosecution witnesses. The court noted that the photographs shared by Turi were related to ISRO’s Space Applications Centre and were taken without authorization. Despite Mehta’s arguments, the court deemed Turi’s actions to be a violation of trust and potentially detrimental to national security.
