Exchange of some hot words between the Court and the counsel not grounds for transferring cases: HC Jammu & Kashmir

Single-judge Justice Sanjay Dhar upheld an order of the Chief Judicial Magistrate declining to transfer the case from the Court of Judicial Magistrate 1st Class, Srinagar to any other court. The High Court of Jammu & Kashmir and Ladakh recently ruled that heated exchange of words between the judges and lawyers cannot be a ground for the transfer of a case from one court to another.

“It is not a ground for transfer of a case if there is an exchange of some hot words between the Court and the counsel. Thus the decision of the learned Chief Judicial Magistrate Srinagar to decline the transfer of the matter from the trial Magistrate is legally correct and cannot be interfered with,” the Court said.
